Advice Goddess: Boy meeks girl

Q: Recently, you wrote about “female flirting moves recognized across cultures” — smiling, making eye contact and looking away, toying with hair or objects, and touching a guy’s arm. I disagree about them being “recognized.” Female employers have made eye contact and even smiled, but that didn’t mean they wanted a romantic relationship. If a woman new york auto insurance quotes toys with an object, it usually means she’s restless and soon will tell me she has somewhere else to be. As for arm-touching, once, when I was on the phone with an auto insurance agent, a receptionist tapped my hand to remind me to mention something. In contrast, when I met my former girlfriend, she grabbed me in such a way that she clearly let me know where I stood with her

Md. Court of Appeals: PIP trumps health insurance

Md. Court of Appeals: PIP trumps health insurance

Daily Record, The (Baltimore), Oct 21, 2009 by Steve Lash

Maryland health insurance companies need not cover the medical costs of auto accident victims due to a state law requiring automobile insurers to carry personal injury protection for drivers, the state’s top court ruled Tuesday in a class-action lawsuit.

The Court of Appeals’ 6-1 decision marked a setback for a class of injured motorists who claimed that MAMSI Life & Health Insurance Co. was obligated by statute to make good on policies requiring it to pay medical expenses, including those resulting from automobile accidents. Had MAMSI paid for beneficiaries’ medical costs, they could have used the insurance money under personal injury protection, or PIP, to cover other expenses, such as lost wages.

With the statutory issue resolved in the company’s favor, the case will return to U.S. District Court in Baltimore on the narrower claim that MAMSI breached a provision in the policy contract requiring it to provide health coverage to injured motorists, regardless of the statute.

The motorists allege that, contrary to the policy contract, MAMSI’s separate contract with physicians required them to exhaust the drivers’ auto insurance coverage before billing the company.

The company denies any wrongdoing.

Plaintiffs’ attorney Dennis F. O’Brien expressed cautious optimism that his clients would prevail on the breach of contract claim.

“It’s kind of hard to predict where it goes from here, other than back to district court,” said O’Brien, a solo practitioner in Bel Air. “We’ll be back on Lombard Street, [where the federal court is located].”

MAMSI’s attorney, Jeffrey A. Lutsky, said the court’s decision on the statutory matter will lead to a “significant” reduction in the size of the plaintiffs’ class because the remaining allegation is based on a contract provision that was contained in only a small number of the company’s policy agreements. Lutsky is managing partner at Stradley, Ronon, Stevens & Young LLP’s Philadelphia office.

The statutory issue was presented to the high court not by O’Brien or Lutsky but by U.S. District Judge Richard D. Bennett, in whose Baltimore courtroom the class-action litigation is being heard.

Bennett, in his pretrial consideration of the case, asked the high court to resolve whether a health insurance policy can be “secondary” to personal injury protection, or PIP, under Maryland law. The issue had never been considered by the Court of Appeals.

Writing for the high court, Judge Clayton Greene Jr. said Maryland health insurance law holds that PIP insurance is primary but permits other health insurance to be secondary. The General Assembly, which first required PIP coverage in 1972, sought to ensure that injured motorists have access to health care, regardless of fault maryland auto insurance quotes or whether they have other insurance

Dark ‘Radio Hour: Alice’ is real treat

“RADIO HOUR: ALICE,” Plan-B Theatre Company, through Oct. 31, Rose Wagner Center (801-355-2787); running time: one hour (no intermission)

Midway through Plan-B Theatre Company’s production of “Radio Hour: Alice,” I found myself thinking, “This is what can happen when talented, creative people get together and do what they do so well.”

It’s a complete joy.

“Radio Hour: Alice” is the fifth and final installment of the company’s Halloween radio hours. This time, resident playwright Matthew Ivan Bennett takes the already dark world of Lewis Carroll’s “Alice in Wonderland” and twists it, making the characters uglier and the story a whole lot creepier.

Though the bulk of the live performances are sold out, you can still experience the show as it was meant to be … on the radio. “Alice” will air on KUER and XM channel 133 Friday at 11 a.m. and 7 p.m.

But by not sitting in the black box theater, you won’t see the most darling Cheshire cat, actor Jay Perry, stretching his lips from ear to ear. You won’t see Teresa Sanderson’s face, stern and cold as she shouts, “Off with her head!” And you won’t see musician David Evanoff play parts of the score using his iPhone as the instrument.

But listening to the radio may be the only way to appreciate the beautifully descriptive language of Bennett — who perfectly creates, describes and illustrates Alice’s dark wonderland, and it is an absolute treat.

Doing the words justice, with his commanding voice, is Bill Allred (from X96’s Radio From Hell), who flawlessly delivers Bennett’s words, bringing the characters, setting and nightmare to life.

Another reason Bennett’s story is so wonderland costume vivid is Evanoff’s original music — an entire score, inventive and creative
